DMCA Policy

DesignPal (“we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

1. Reporting Copyright Infringement

If you believe that content available on or through our Website or Services infringes your copyright, you may submit a written notification to our designated DMCA agent. Your notification must include the following information:

1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
2. Identification of the infringing material: A description of the material that you claim is infringing and its location on our Website or Services, with sufficient detail to permit us to locate the material (e.g., a URL or specific page reference).
3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:

1. Identification of the material: A description of the material that was removed or disabled and its former location on our Website or Services.
2. Statement under penalty of perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which DesignPal may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
5. Signature: A physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the original party does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we may restore the removed material.

4. Repeat Infringers

In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. We may also, in our sole discretion, limit access to the Website or Services and/or terminate the accounts of any users who infringe any intellectual property rights, whether or not there is any repeat infringement.

5. Misrepresentation Warning

Please be advised that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. We recommend consulting with an attorney before submitting a DMCA notice or counter-notification.
